Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Plancv AI resume builder platform operated by PlanCV, Inc. ("PlanCV," "we," "us," or "our"), available at plancv.com and app.plancv.com (the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 16 years old to use the Service. By using Plancv, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

To access most features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to notify us immediately at support@plancv.com if you suspect unauthorized access to your account. PlanCV is not liable for any loss arising from unauthorized use of your account.

Plancv provides an AI-powered resume building platform that includes: AI resume generation and optimization, ATS (Applicant Tracking System) compatibility scoring, job description matching and tailoring, grammar and impact polishing, resume templates, and analytics features.

The Service uses artificial intelligence models to generate and optimize resume content. AI-generated suggestions are starting points and should be reviewed and edited by you to ensure accuracy. PlanCV does not guarantee that AI-generated content is factually correct or that using our Service will result in employment.

Free Plan: Includes limited features as described on our pricing page. Free plans may be modified or discontinued with 30 days notice.

Professional Plan: Paid subscription billed monthly or annually as selected at checkout. Prices are listed on our pricing page and are subject to change with 30 days notice to existing subscribers.

Payment: All payments are processed securely through Stripe. By subscribing, you authorize recurring charges to your payment method. Prices are in US dollars unless otherwise stated.

Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Refunds: If you are unsatisfied with your subscription, contact support@plancv.com within 14 days of your initial purchase for a full refund. Refunds are not available after the 14-day period or for renewal charges.

You agree not to use the Service to:

Create resumes containing false, misleading, or fraudulent information about your qualifications, experience, or credentials.

Generate content that is defamatory, obscene, harassing, threatening, or that violates the rights of any third party.

Attempt to reverse-engineer, decompile, or extract the AI models, algorithms, or proprietary technology underlying the Service.

Use automated scripts, bots, or scrapers to access the Service or extract data at scale.

Resell, redistribute, or commercially exploit the Service or any content generated through it without our prior written consent.

Circumvent usage limits, rate limits, or security measures.

Violate any applicable law or regulation.

Your Content: You retain ownership of the personal information, work history, and original content you provide to the Service. By using Plancv, you grant us a limited license to process your content solely to provide and improve the Service.

AI-Generated Content: Resume text, bullet points, and suggestions generated by our AI are created for your personal use. You own the output generated for your resumes and may use it freely for job applications and professional purposes.

Our Platform: The Plancv platform, including its design, code, AI models, templates, and branding, is owned by PlanCV, Inc. and protected by intellectual property laws. You may not copy, modify, or distribute any part of our platform without written permission.

Templates: Resume templates are licensed for personal use only. You may not redistribute, resell, or use templates for commercial purposes outside of your own job applications.

Plancv uses AI to generate and optimize resume content. While we strive for accuracy and quality:

AI-generated content may contain errors, inaccuracies, or suggestions that do not accurately reflect your experience. You are solely responsible for reviewing and verifying all content before using it.

We do not guarantee that AI-generated resumes will result in interviews, job offers, or any specific employment outcome.

ATS scores and job match percentages are estimates based on our analysis and may not reflect the exact scoring of any specific employer's ATS system.

You should never include false information on your resume, even if suggested by our AI. Misrepresenting qualifications on a resume may have legal consequences.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy.

You may delete your account and all associated data at any time from your account settings. Upon deletion, your resume data is permanently removed within 30 days.

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. For material changes affecting paid subscribers, we will provide at least 30 days notice.

To the maximum extent permitted by law, PlanCV, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of employment opportunities, loss of income, or loss of data, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to PlanCV in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to indemnify and hold harmless PlanCV, Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any content you submit through the Service.

You may terminate your account at any time by deleting it from your account settings or emailing support@plancv.com.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any reason with 30 days written notice. In cases of severe violations (fraud, illegal activity), we may terminate immediately without notice.

Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination (Intellectual Property, Limitation of Liability, Indemnification, Governing Law) shall survive.

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting legal@plancv.com. If unresolved within 60 days, disputes shall be submitted to binding arbitration under the American Arbitration Association rules in Richmond, Kentucky.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

We may update these Terms from time to time. The "Last updated" date at the top indicates the most recent revision. For material changes, we will notify you by email or prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes.
